When A Parent Is Evading Child Support Payments

Sometimes a paying parent tries to avoid paying child support by concealing the total income earned or avoids child support payment by being underemployed, employed only on part time basis or working for cash. The paying parent may deliberately try to evade their responsibility by not reporting their total income earned and providing falsified information.

When Income Is Not Reflected In Formal Documents

Sometimes for instance, for the self employed, people who earn tips or those who earn income through cash, our formal documents do not always provide a full picture of the gross annual income.

Your support calculations should be a reflection of all of our income.  If a paying parent is not paying support based on their true, full income, the receiving parent may have to go to court and request that a judge review the actual income.  A judge can set the income to a more realistic value (impute their income).

Imputing An Income

When imputing an income, a judge will declare that the paying parent actually has a higher earning capacity than what is stated. The judge will arrive at this conclusion based on the payor’s work history, past income, education, life style and job opportunities.

The Judge will then declare (impute) the amount of income that will be used for support calculations based on what the judge thinks that  parent is actually earning or what they are capable of earning.
