Can I Move With My Child?

A parent may want to move with their children after a separation or divorce. The move may be due to the parent’s new job opportunity, better housing facility, closeness to the family support or a new partner. However, this move is not necessarily automatically allowed and may be curtailed by several external factors.

Is A Move "Convenient?"

The move will be considered convenient if it does not change the child’s school, child care arrangements or the accessibility schedules for the other parent. In these cases, consent of the other parent is not required. Permission is required though when:

  1. The move causes hardship to the visitation rights of the other parent
  2. The move changes the child’s school and other facilities.
