All About Serving Documents

“Service” is giving notice to the other party that a case has been started in court or that a step is being taken in the case. In Family Law Court proceedings documents are “served” to everyone involved. This means that copies of the documents are given to both parties to the proceeding. The purpose of serving documents is to make sure that everyone knows the details and information given to the Court .

Serving Documents

Normally you can choose to serve the documents yourself. For many documents in family law, you actually cannot serve your spouse yourself.  Therefore a friend, relative or any person above the age of 18 can also serve the documents. You may also hire a professional process server to deliver the documents for a fixed fee. Whoever serves documents must follow proper procedures:

  1. You may mail, courier, email or fax the documents to your partner or their lawyer
