WHERE: Which Court House DO I Go To?

Depending on where you live in Ontario, there are three different Courts to deal with different family law issues.  Some communities have family issues separated between the Superior Court of Justice and the Ontario Court of Justice.  In other communities there is a unified family court system called the Family Court of the Superior Court of Justice. You need to know which Court will deal with your specific family law issue in your community.

Family Court of the Superior Court of Justice

In some communities, ALL family law matters are dealt with by a unified family court system called the Family Court of the Superior Court of Justice. These courts can deal with all family law matters, including divorce, custody, access, division of property, adoption and child protection.

Superior Court of Justice

If there is no unified court and you want to apply for your final divorce decree (or if your final divorce decree also includes division of property, custody, access or support), you go to the Superior Court of Justice.

Ontario Court of Justice

If there is no unified family court system in your community and you are only addressing child support, spousal support, child custody, access to your children or child protection matters you go to the Ontario Court of Justice. The Ontario Court of Justice does NOT deal with the division of family possessions or your divorce decree (which would happen at The Superior Court of Justice.)
