Child Support After My Kids Turn 18

A child above the age of 18 years, may still be considered as a dependent child based on the factors::

Dependent Children Over The Age of 18

  • There is a disability or illness suffered by the child. A child may remain as a dependent for their entire life if the child is permanently disabled or suffers a chronic illness.
  • The child is going to school on a full-time basis. If a child is pursuing post-secondary education or an undergraduate degree, then the parent is  responsible to continue paying child support to the other parent. Child support will be extended until the child graduates from school.

Post-Secondary Education

The Court may order child support for the purpose of your child obtaining more than one degree. However, the Court uses its discretionary power to determine the amount of support based on the table guidelines. As well, the Court may insist that the child also contribute towards their expenses under special circumstances. Therefore, the range of financial support provided to the child is  on a case-to-case basis
